Masimo Files Lawsuit Against U.S. to Halt Apple Watch Feature

Masimo has initiated legal action against the U.S. federal government, specifically targeting the U.S. Customs and Border Protection, in a bid to prevent the reintroduction of the pulse oximetry feature on the Apple Watch. This feature, which measures blood oxygen levels, was recently announced to be restored by Apple, a move that took Masimo by surprise.
The ongoing dispute between Masimo and Apple extends back to 2020, centered around allegations of patent infringement. In 2022, the U.S. International Trade Commission ruled that Apple had violated Masimo’s patents related to the blood oxygen detection technology. As a result, Apple was expected to maintain the feature’s absence until at least the expiration of Masimo’s patent in 2028.
On August 14, 2023, Apple publicly disclosed its plans to reactivate the blood oxygen detection capability, which had been previously banned due to the patent ruling. This announcement was the first indication for Masimo that a resolution allowing Apple to reinstate the feature was imminent. The company’s legal action, filed on August 20, 2023, reflects its concerns regarding the competitive implications of Apple’s decision.
According to a report by Bloomberg Law, Masimo’s lawsuit emphasizes the potential harm to its business interests should Apple proceed with the reactivation of the pulse oximetry feature. The complaint seeks to halt the process until the legal disputes surrounding the patents are fully resolved.
