Apple has launched an appeal with the Ninth Circuit Court regarding recent changes to its App Store, arguing that the modifications are unconstitutional. The company claims these changes extend the injunction “beyond what is permissible by law.” This legal battle stems from a lawsuit initiated by Epic Games, which accused Apple of maintaining an illegal monopoly and enforcing anti-competitive practices against app developers.

The dispute began several years ago when Epic Games challenged Apple’s commission structure, which required developers to use the App Store’s payment system for in-app purchases. In a landmark decision, the court ruled in favor of Epic, mandating that Apple allow developers to link to external payment sources. This ruling was intended to provide users with more purchasing options, circumventing Apple’s fee structure on in-app transactions.

In compliance with the court’s ruling, Apple implemented the necessary changes in 2024. However, the company introduced a fee for developers who opted to link to external payment methods, prompting Epic to return to court. Epic argued that these fees violated the original court ruling. In response, the judge reaffirmed the requirement that Apple allow developers to link to external payment options without imposing any fees, which is the ruling currently under appeal by Apple.

Apple’s Argument Against the Modified Injunction

In its appeal, Apple contends that the injunction has been “improperly expanded and modified.” The company aims to have the court dismiss the revised injunction and revert to the original terms. Should this appeal succeed, Apple may reinstate its fees for external links, which would significantly impact developers operating within its ecosystem.

Currently, developers in the United States can include links to external payment systems without incurring additional costs. It remains uncertain how the Ninth Circuit Court will respond to Apple’s appeal or when any subsequent changes might occur if the appeal is successful.

The ongoing legal conflicts are not limited to Apple. Epic Games has also criticized Apple’s terms in the European Union, labeling them as punitive toward developers.
