EU Investigates Elon Musk’s Grok AI Over Childlike Deepfakes
The European Commission has announced a serious investigation into allegations that Elon Musk’s AI tool, Grok, is being used to create and distribute sexually explicit images resembling minors. The Commission’s concern centers on Grok’s “spicy mode,” which reportedly generates explicit content, raising significant legal and ethical issues. EU digital affairs spokesperson Thomas Regnier described the situation as “appalling,” emphasizing that such content “has no place in Europe.”
The scrutiny began following complaints that emerged after Grok’s “edit image” feature was introduced on the social media platform X, which Musk oversees. This feature has drawn criticism for its potential misuse, particularly concerning the generation of childlike images in explicit contexts. In response to the growing backlash, xAI, the company behind Grok, indicated that it is actively working to address flaws within the AI tool.
Expanded Investigations and Past Penalties
The public prosecutor’s office in Paris has broadened its ongoing investigation into X to encompass these new allegations regarding Grok’s use in creating and disseminating child pornography. This development adds to X’s already complicated relationship with European regulators. In December 2023, the platform faced a significant penalty of 120 million euros (approximately $140 million) for violating EU regulations pertaining to transparency in digital advertising and user verification processes.
The European Commission is currently investigating X under the provisions of the EU’s Digital Services Act, which began in December 2023. Regnier reiterated the Commission’s commitment to enforcing compliance, stating, “I think X is very well aware that we’re very serious about DSA enforcement.” He also mentioned that X had responded to requests for information regarding controversial comments made about the Holocaust.
Regulatory Context and Future Implications
The investigation into Grok is part of a broader effort by the EU to ensure the safety and legality of digital content across its member states. The Commission serves as the EU’s digital watchdog, tasked with enforcing regulations that protect users from harmful online materials. With this latest controversy, the scrutiny on AI technologies and their applications is likely to intensify, prompting companies to rethink their compliance strategies.
As concerns grow about the implications of generative AI, the situation underscores the challenges regulators face in addressing rapidly evolving technologies.
