US Border Phone Searches Reach Record Highs, Prompt Privacy Debate
Concerns surrounding privacy have intensified as phone searches at the US border have surged to a record high. According to data from the US Customs and Border Protection (CBP), officials conducted searches on 14,899 devices belonging to international travelers between April and June 2025. This figure marks a 17% increase from the previous record set in early 2022.
The CBP maintains that the majority of these searches are “basic.” Travelers are required to present their devices and passwords to agents, who then inspect the contents without specialized equipment. The agency states that these searches are essential for identifying and combating various forms of illegal activity, including terrorism, child pornography, drug smuggling, and human trafficking.
Legal Justifications and Implications
The CBP argues that border searches of electronic devices are often crucial in determining an individual’s intentions when entering the United States. This process is considered relevant to the admissibility of foreign nationals under US immigration laws. The agency’s website highlights that these searches are part of a broader strategy to enhance national security.
The increase in phone searches aligns with the enforcement measures implemented during the Trump administration, which aimed to tighten migration controls. Reports have surfaced of travelers facing lengthy detentions or being denied entry based on the contents of their devices, even when they possess valid travel documents and visas.
Esha Bhandari, a deputy director at the American Civil Liberties Union (ACLU), expressed concern over these practices. In an interview with WIRED, Bhandari stated, “This is essentially a limitless authority that they claim for themselves to search travelers without a warrant to search the full scope of information people carry on them.” This statement underscores growing apprehension about the implications for personal privacy and civil liberties.
