School Board’s Investigation Request Overturned Following Procedural Errors

On August 19, 2023, trustees of the Near North District School Board voted to request an investigation by the Ministry of Education into the actions of Craig Myles, the Director of Education, and other senior administration members. This motion was prompted by concerns over the handling of a delayed opening for a new JK-12 school in Parry Sound.

Shortly after, on August 25, board chair Ashley St. Pierre issued a public apology on behalf of the trustees. In her written statement, she addressed what she described as the “unfair treatment” of the administration. St. Pierre stated, “The Near North District School Board (NNDSB) Board of Trustees wishes to address recent events concerning the unfair treatment of NNDSB administration.”

The situation took a turn when St. Pierre clarified that the special meeting held on August 19 did not comply with the requirements outlined in the Education Act and related board bylaws. She explained that she had contacted the Ontario Public School Boards’ Association regarding the meeting’s legitimacy. “The information I received back made it clear the meeting shouldn’t have taken place without the Director and the fact he didn’t assign a designate,” she noted.

St. Pierre further explained that the motion requesting the investigation was improperly submitted, as it was presented only one hour before the meeting. “As a result, the meeting is considered null and void,” she added. All motions passed, including the investigation request, are now invalid.

During the August 19 meeting, Jay Aspin and John Arkwright were sworn in as new trustees. St. Pierre confirmed that they would need to be sworn in again at a future date, as all items on the agenda from that meeting are now null and void.

Reflecting on the events, St. Pierre acknowledged, “Our actions created uncertainty and concern among staff and the public. We recognize that the way in which this matter was handled did not reflect the standards of fairness, professionalism, and collaboration that our communities expect of us.” She extended a formal apology to the NNDSB administration, employees, and the public, expressing regret over the impact on trust and confidence in the school system.

The board chair emphasized the board’s commitment to improving governance practices. She affirmed that the primary focus remains on providing safe and supportive learning environments for all students.

This incident highlights the importance of adhering to procedural protocols in educational governance, ensuring that board actions are both transparent and accountable. The NNDSB trustees are under pressure to restore confidence in their leadership as they navigate this setback.
