U.S. and Ukraine Forge Agreement Amidst Ongoing Territorial Disputes
The United States and Ukraine have reached a preliminary agreement on key issues aimed at ending the prolonged conflict that has persisted for nearly four years. Despite this progress, significant challenges remain, particularly concerning territorial disputes in Ukraine’s eastern regions and the management of the Zaporizhzhia nuclear power plant, as articulated by Ukrainian President Volodymyr Zelenskyy.
During a press briefing in Kyiv, Zelenskyy outlined the main components of the draft proposal, which integrates Ukraine’s political and commercial interests to enhance both security and economic potential. The details of the plan were disclosed to journalists on Tuesday, although the information was under embargo until Wednesday morning. While the draft reflects Ukrainian aspirations, it also seeks to establish a framework for dialogue with Russia.
Kremlin spokesperson Dmitry Peskov responded to inquiries about the negotiations, stating that Moscow would provide its position based on discussions held by Russian presidential envoy Kirill Dmitriev with U.S. representatives in Florida over the weekend. Peskov refrained from elaborating further, emphasizing that Moscow prefers to conduct its communications without media involvement.
Contentious Territorial Issues
At the center of ongoing negotiations is the contentious territorial dispute over the Donetsk and Luhansk regions, collectively known as the Donbas. Zelenskyy characterized this issue as “the most difficult point” in the negotiations, asserting that these matters would require discussion at the leadership level. Russia continues to assert its demands, insisting that Ukraine yield remaining territories in the Donbas, a position Ukraine has firmly rejected. Currently, Russian forces control most of Luhansk and approximately 70% of Donetsk.
In an effort to facilitate compromise, the United States has proposed transforming the contested regions into free economic zones. However, Ukraine demands that any arrangement be contingent upon a referendum, allowing its citizens to determine their own future. Zelenskyy has emphasized the necessity for demilitarization in the area and the presence of an international force to ensure stability.
Another significant point of contention is the management of the Zaporizhzhia nuclear power plant, the largest in Europe, currently under Russian occupation. The U.S. has suggested a consortium involving Ukraine and Russia, with equal stakes for each party. In contrast, Zelenskyy proposed a joint venture between the U.S. and Ukraine, allowing the U.S. to decide on the distribution of its share, which he believed would likely exclude Russia.
“We did not reach a consensus with the American side on the territory of the Donetsk region and on the ZNPP,” Zelenskyy stated. “But we have significantly brought most of the positions closer together. In principle, all other consensus in this agreement has been found between us and them.”
Framework for Future Cooperation
Among the points of the draft, Point 14, which addresses territories along the eastern front line, and Point 12, concerning the management of the Zaporizhzhia plant, are anticipated to be major sticking points in forthcoming discussions. Zelenskyy noted the complexity of the negotiations, stating, “We are in a situation where the Russians want us to leave the Donetsk region, and the Americans are trying to find a way so that it is ‘not a way out’ — because we are against leaving.”
The draft proposes that the contact line, which spans five Ukrainian regions, be frozen once the agreement is signed. Ukraine insists that any movement toward establishing a free economic zone requires ratification by a referendum, ensuring that the decision ultimately lies with the Ukrainian populace. Zelenskyy indicated that this process would require 60 days, during which hostilities should cease to enable a peaceful transition.
Further discussions will center around the required withdrawal of troops and the positioning of international forces. Zelenskyy called for a definitive choice from the populace: “people can choose: this ending suits us or not.”
The draft also recommends the withdrawal of Russian forces from the Dnipropetrovsk, Mykolaiv, Sumy, and Kharkiv regions, with international forces positioned along the contact line to monitor the agreement’s implementation. “Since there is no faith in the Russians, and they have repeatedly broken their promises, today’s contact line is turning into a line of a de facto free economic zone, and international forces should be there to guarantee that no one will enter there under any guise — neither ‘little green men’ nor Russian military disguised as civilians,” Zelenskyy stated.
In terms of managing the Zaporizhzhia nuclear power plant, Ukraine is advocating for the occupied city of Enerhodar, linked to the facility, to be designated as a demilitarized free economic zone. Zelenskyy mentioned that discussions regarding the plant required around 15 hours of negotiations with U.S. officials. The current U.S. proposal suggests that the plant be jointly operated by Ukraine, the U.S., and Russia, with each party receiving dividends. Zelenskyy expressed skepticism, stating, “It is clear that for Ukraine this sounds very unsuccessful and not entirely realistic. How can you have joint commerce with the Russians after everything?”
Ukraine’s alternative proposal suggests a joint venture with the U.S., allowing Americans to independently determine the distribution of their share. Zelenskyy highlighted the necessity for significant investment to restore the plant and its adjacent infrastructure.
Security Guarantees and Economic Recovery
The draft agreement also includes provisions for strong security guarantees for Ukraine, akin to NATO’s Article 5, obligating partners to respond in the event of renewed Russian aggression. Zelenskyy indicated that a separate bilateral document with the U.S. would outline these guarantees, detailing conditions for security provisions and establishing a mechanism to monitor the ceasefire. This mechanism is expected to utilize satellite technology and early warning systems for effective oversight.
“The mood of the United States of America is that this is an unprecedented step towards Ukraine on their part. They believe that they are giving strong security guarantees,” Zelenskyy said.
Additional components of the draft proposal include maintaining Ukraine’s military strength at 800,000 personnel during peacetime and establishing a specific timeline for ascension to the European Union.
The agreement aims to expedite a free trade agreement between Ukraine and the U.S. and seeks similar terms with Russia. Ukraine aspires to obtain preferential access to European markets and a comprehensive development package, targeting various sectors, including technology and reconstruction efforts. Zelenskyy stated, “Ukraine will have the opportunity to determine the priorities for distributing its share of funds in the territories under the control of Ukraine.”
The draft also mandates that Ukraine hold elections following the agreement’s signing. Moreover, Ukraine insists on the immediate release of all prisoners detained since 2014, focusing on civilian detainees, political prisoners, and children.
The outcome of these negotiations represents a crucial step in the ongoing conflict, with hope for a resolution that prioritizes both territorial integrity and the welfare of Ukraine’s citizens.
